LAYOVER AT CONCOURSE RENTAL AGREEMENT
Dear Layover Guest!
Thank you for arranging your stay with Layover.
We know you will enjoy visiting Crosstown Concourse and we look forward to providing you with relaxing and comfortable accommodations during your stay. This communication is our Rental Agreement. It includes our property rules and our legal policies. It also includes our potential fees if our policies and rules are not followed.
As our registered guest, you agree to abide by these rules, regulations and policies of Layover at Concourse.
Please read through this document, then sign and return to Layover at Concourse.
Our Guests are guests of both Layover at Concourse, Parcels at Concourse and Crosstown Concourse. Please respect the local community and our company by abiding by the following rules to ensure a comfortable and carefree stay.
1. Our Guest(s) agree that there will be NO PARTIES anywhere on the property and agree to respect the property’s permanent residents, rules and staff*
2. Our Guest(s) agree to NO SMOKING of any substance in the unit or on the property.*
3. Our Guest(s) are responsible for actions of ALL GUESTS and Authorized Visitors occupying the property at all times.
4. Our Guest(s) agree to return all keys and access fobs and cards upon completion of their stay.*
5. Our Guest(s) agree to abide by occupancy requirements for their specific apartment and seek authorization for additional Visitors.
6. Our Guest(s) understand that onsite building staff is not affiliated with Layover at Concourse and may not be willing to assist the guest. Please call Layover at Concourse 901.443.4406 for assistance and we will do our best to help!
7. Our Guest(s) agree to leave pets (and service animals) at home, without prior written authorization from Layover at Concourse.
8. Our Guest(s) agree to only attempt to enter their Vacation Home during the time period reserved and only after this contract has been signed.
9. Our Guest(s) agree that Layover at Concourse is authorized to pursue compensation for negligent or willful violations of the Rental Contract. *
10. Our Guest(s) understand they are responsible for all contents in the unit from check-in until check out. Guests will be responsible for any damage to any contents that occurs during their stay.
Thank you for observing our rules and allowing us to provide special and fun accommodations while maintaining an outstanding relationship with the residents of Parcels and Crosstown Concourse.

This section details rules and what to expect as part of a Layover at Concourse reservation.
VACATION HOME – Furnishings and Floor plans may appear to differ from pictures on advertisements however Layover at Concourse will provide a vacation home with comparable floor plan, square footage and features described in this rental agreement. Specific views and unit numbers may be requested, and we will do our best to meet the request, but it cannot be guaranteed.
WHAT WE SUPPLY – The apartment is equipped and set up as a fully furnished property. This includes bedspreads, linens, blankets, pillows, towels, a standard equipped kitchen, TV(s), and furnishings. We may not have all the items you may be accustomed to having in your home. If there is a special type of item you are accustomed to using please provide for those items by bringing them with you.
The list of items included in the apartment is listed on the reservation. There are six towels and six wash cloths per bathroom. We are not a hotel and are unable to supply additional towels like a hotel may be able. However, the washer and dryer in each apartment has a small supply of detergent if washing towels is desired.
PARTY/NOISE COMPLAINTS – Please respect the people that call this building home. Parties and noise complaints are taken VERY seriously. If a noise complaint occurs, guests will be notified via email or phone. Layover at Concourse may send security to the apartment to verify complaint, warn guests of the complaint and make a report on activities and the number of occupants in the unit. Guests in violation of occupancy limit or party rules may be removed from unit. If a second noise complaint is received after the initial warning, guests will be immediately removed from the property. Guests evicted from property will have their reservation considered cancelled by The Guest and additional penalties may apply*
If the police are called to a property for any reason relating to any disturbance, occupancy issues, noise, or lewd behavior, the Guest will be charged a fine of $2,000 in addition to the normal costs of rental and any damage to the property.*
MAINTENANCE – Please report any maintenance issues to Layover at Concourse at 901.433.4406 as soon as they are identified. If a maintenance issue occurs that cannot be fixed in a reasonable amount of time, and significantly affects The Guests stay, Layover reserves the right to issue a refund or relocate Guests to another apartment. Guests will be responsible for all willful or negligent damages to apartment furnishings, features and property.
Housekeeping issues are to be addressed immediately upon arrival, but in no way void this contract. Layover at Concourse must be contacted immediately and the situation will be assessed at that time.
INTERNET/CABLE – Layover provides complimentary wireless internet and cable TV with all properties as a convenience for The Guest. If The Guest has any problems accessing the internet, please notify Layover at Concourse immediately. Please note that internet connectivity issues are often outside of Layover’s control. While we will do our best to work with the Internet Service Provider to resolve connectivity issues as quickly as possible, we are at the mercy of the service provider to resolve issues. As this is a complimentary service, no refunds will be assessed for internet connectivity issues. In addition to the apartment having internet service, Crosstown Concourse has an accessible WiFi service that may be used by all guests while on campus.
WEATHER – Layover does not provide refunds due to issues beyond Layover’s control such as weather.
PAYMENT AND LEGAL POLICIES
This section details rules and requirements for making and maintaining a reservation with Layover at Concourse.
PURCHASE AGREEMENT – By Providing Payment information, The Guest(s) has agreed to purchase a reservation from Layover at Concourse. The Cancellation Policy and Rental Agreement signing period begins at the time of this purchase agreement. If Layover at Concourse is unable to provide available dates in purchased rental property, Layover at Concourse is obligated to provide a comparable alternative. If Layover at Concourse is unable to provide a comparable alternative, Layover at Concourse will refund the purchase to the Guest(s).
CANCELLATION POLICY – At the time of booking, a 25% deposit of total rental charges is made. The Guest has 24 hours from making the reservation to cancel the booking for a full refund. After 24 hours, the 25% deposit becomes nonrefundable. 14 days prior to arrival, we automatically collect the remaining balance, and the total is nonrefundable if cancelled. If reservation is cancelled within 14 days of arrival, Layover at Concourse will seek to rebook the property and will reimburse the Guest for what we are able to re-book. Reimbursement will be assessed the day after the check-out of the cancelled reservation.
CHANGES TO RESERVATION – Changes to Reservation dates without penalty more than 14 days prior to arrival are allowed at the discretion of Layover at Concourse. A 25% cancellation fee for cancelled nights may be applied. Changes to Reservations dates within 14 days of arrival are considered cancelled and are subject to the above cancellation policy.
RENTAL AGREEMENT SIGNING PERIOD – Layover at Concourse may consider a reservation as cancelled by the Guest(s) if the Rental Agreement is not signed within 4 days of the Purchase Agreement being made or before the arrival date, whichever range of dates is the shortest. Cancellation of Purchase Agreement due to Guest(s) declining to agree to this Rental Agreement must occur within the 24 hour Cancellation period to avoid penalties.
PUBLIC RECORDS CHECK- For a stay reserved for 14 days or longer the guest’s name and birthdate may be submitted to a basic public records search by request of the building owners. Only the result of the search, Guest(s) names, assigned unit number and reservation dates will be submitted to the building owners. No other information will be shared. Layover at Concourse reserves the right to cancel a purchase agreement at the request of building owners. In the event of this cancellation, Layover at Concourse will refund the stay in full. Layover at Concourse may separately provide name(s) of Guest(s) authorized on premises to property staff.
COLLECTION OF PAYMENT – Layover at Concourse may consider the purchase agreement as cancelled if initial deposit cannot be collected within 24 hours. Layover at Concourse may consider the reservation as Cancelled by the Guest if payment in full cannot be collected within 5 days of the payment due date. Layover at Concourse will make a good faith effort to contact guests and collect payment prior to cancellation. Reservations cancelled in this way will forfeit their deposit.
LIABILITY – Layover is not responsible for any personal effects of The Guest that may disappear from the apartment. Layover maintains insurance on the structure and those items belonging to Layover. The Guest is responsible for insurance on all of Guest’s personal items. The Guest will be fully responsible for all damage to the suite or contents during their stay. In the event that the apartment becomes un-rentable through any action of The Guest, then The Guest agrees to pay the nightly rate as specified in the “Rates” section until the suite may be put back into a rentable condition, in addition to being responsible for any damage caused by Guest, their invites, or other persons. The Guest agrees to indemnify Layover and hold it harmless from any injury or damage resulting to The Guest, their invites, or other persons, their personal property, the apartment, its contents, or the property, occurring in the apartment itself or in any common areas including, but not limited to, stairways, parking lots, and recreational areas that may be used by The Guest, their invites, or other persons. The total liability to Layover from any loss to The Guest due to interruption of essential services, fire, or other occurrences that renders the suite unusable will be only those days of rental that The Guest has prepaid and not used.
USE OF PREMISES – The apartment and associated common areas shall not be used for ANY unlawful or illegal purpose. The Guest agrees to keep the suite in a neat and orderly condition. No nails, screws, or other items are to be driven into any portion of the suite. Only the number of persons indicated on the reservation is allowed to occupy the apartment. The apartment is to be used for residential purposes only. No commercial, industrial, or retail activity can be conducted in the apartment. Layover at Concourse is not responsible for any amenities or services that are closed, out of service, or cannot be used for any reason, and monies will not be refunded for such events.
MISCELLANEOUS – No tenancy is created by this agreement. All property rights remain with Layover. The Guest agrees that Layover or other lawful authority may evict The Guest, without notice, for any reasons such as, but not limited to:
(1) failure to leave the unit at the designated check-in or check-out (unless extended according to the terms of this agreement and authorized in advance by Layover)
(2) nonpayment of rental or other charges
(3) violation of any rule in this agreement
(4) violation of any rules of the housing community or Crosstown Concourse in which the apartment is located
(5) any unlawful act of The Guest.
The Guest agrees to hold Layover harmless for any eviction. The liability of Layover at Concourse is limited to unused rental paid by The Guest.
Layover has 10 working days in which to mail or credit charge card for this unused rental to The Guest.
Unauthorized Late Check Out – $125/hour after 11.a.m local time
Smoking – $1000 + all repair costs to restore property, as a result of any cigarette, e-cigarette, marijuana, cigar, or any smoking of any kind on the property or inside the apartment.
Excessive Cleaning – $125/Hour for cleaning over and above 2 hours
Unauthorized Pets – $1000 + all repair costs to restore property
Broken/Missing Items – Varies from item to item to include repair or replacement, as appropriate
Missing Keys – $50/key
Missing FOB/Key -card- $250/FOB
Party in Unit or Common Area - Removal from Unit and up to $2,000 fine plus any damages to Layover at Concourse, LLC
No breach of any term or any of the rules contained in this agreement or the rules of the housing development Parcels, or Crosstown Concourse will be deemed a breach of this agreement. Layover makes no warranties, expressed or implied. If any provision of this agreement is determined to not be valid or enforceable, the remainder of this agreement will not be affected and each provision will be valid and enforced to the fullest extent of the law.
Layover reserves the right to move The Guest to a comparable suite at any time during this agreement should circumstances beyond the control of Layover arise.
For the mutual convenience of the parties, it is understood and agreed that by making payment as requested, I (the Guest) shall have acknowledged and consented to all terms and conditions of this agreement, on behalf of myself and those in my party. The date of this agreement is the date the reservation is made.
